Terms of use
Version of 19 October 2026.
In the event of any discrepancy, the French version prevails.
1. WHO PROVIDES THE SERVICE
MARMALADE is provided by MARMALADE SOFTWARE LLC, whose contact details appear in the legal notice. The paid subscription is governed by the terms of sale; the words defined there have the same meaning here.
2. ACCOUNT AND ACCESS
2.1. The account is opened in the name of an organisation. Each User has their own personal access, which they do not share.
2.2. The Client chooses its Users' roles and is answerable for their actions in its workspace.
2.3. The Client removes without delay the access of a person who leaves its organisation.
3. SECURITY
3.1. Each User keeps their password secret. Two-factor authentication is offered to every User; MARMALADE may require it for administrator accounts.
3.2. The Client informs MARMALADE without delay if it suspects unauthorised access to its workspace.
4. PROHIBITED USE
The Client and its Users undertake not to:
• try to access another organisation's workspace or circumvent a protection;
• extract data from the Service by automated means other than the exports provided;
• upload a malicious file or unlawful content;
• use the Service to send unsolicited messages;
• resell the Service or make it available to a third party.
5. THE CLIENT'S CONTENT
5.1. The content uploaded remains the property of the Client, which is answerable for it.
5.2. The Client warrants that it holds the rights to the images and texts it uploads, in particular the copyright of living artists and image rights.
6. PUBLIC PAGES AND REPORTING
6.1. When the Client publishes a Public page, it is its publisher. MARMALADE hosts it.
6.2. Anyone may report public content that they consider unlawful to contact@marmalade.art, stating the address of the page, the content concerned and the reason. MARMALADE acknowledges receipt and replies.
6.3. MARMALADE may hide manifestly unlawful content. It informs the Client, giving the reason. The Client may contest the decision at the same address.
7. ARTIFICIAL INTELLIGENCE ASSISTANT
7.1. The assistant's answers are produced by artificial intelligence. They may be inaccurate.
7.2. Its suggestions are never applied without a User's approval.
7.3. The Client does not give it data that it has no right to process.
8. AVAILABILITY AND CHANGES
8.1. MARMALADE develops the Service. An essential feature of the subscribed plan is not withdrawn during the subscription without 30 days' notice.
8.2. Planned maintenance is announced in the Service.
9. SUSPENSION
9.1. MARMALADE may suspend access without notice in the event of a risk to the security of the Service or its clients, or of prohibited use.
9.2. It informs the Client, giving the reason, and restores access as soon as the risk is removed.
10. PERSONAL DATA
The processing of personal data is described in the privacy policy.
11. CHANGES
These terms follow the same rule as the terms of sale: 30 days' notice, cancellation free of charge in the event of refusal.
12. CONTACT
contact@marmalade.art.
