Terms of sale — MARMALADE subscription

Last updated: 12 October 2026

In the event of any discrepancy, the French version prevails.

1. Parties

These terms bind MARMALADE SOFTWARE LLC (“MARMALADE”) and any professional organisation that takes out a subscription (“the Client”). They prevail over any other document of the Client.

2. Purpose

MARMALADE provides online management software for galleries, dealers, publishers and artists, according to the plan chosen. The content of each plan is the one described on the plans page on the date of subscription.

3. Trial

Every new organisation is entitled to a 30-day free trial, without a credit card. At the end of the trial, write access is suspended until a plan is chosen; the data remains viewable and exportable.

4. Prices

Prices are stated excluding taxes, in euros: Artist €29, Studio €69, Gallery Pro €149, Gallery Business €249 per month. A price change applies from the following period, after 30 days' notice by email.

5. Payment

The subscription is paid in advance, by card or direct debit, through MARMALADE's payment provider: every month for the monthly subscription, in a single payment for the annual subscription.

6. VAT and invoicing

Invoices are issued by MARMALADE SOFTWARE LLC, established outside the European Union. For a professional Client established in the Union, any VAT due is paid by the Client under the reverse-charge mechanism.

7. Term and termination

The subscription renews automatically, monthly or yearly. The Client may terminate at any time from its settings; termination takes effect at the end of the paid period, with no refund for the current period.

8. Late payment

Any late payment gives rise to penalties at the interest rate applied by the European Central Bank to its most recent refinancing operation, plus 10 percentage points, and to a fixed indemnity of €40 for recovery costs. MARMALADE may suspend access after a reminder that has remained unanswered for 15 days.

9. Client data

The data entered remains the property of the Client and can be exported at any time. After the end of the subscription, it remains exportable for 30 days, then is deleted, unless there is a legal obligation to keep it. MARMALADE acts as a processor for this data (see the privacy policy).

10. Availability

MARMALADE uses its best efforts to keep the service continuously available, except for announced maintenance. A full backup is made every night.

11. Liability

The content, prices and documents issued by the Client remain its responsibility. MARMALADE's liability is limited to direct damage, up to the amounts paid by the Client over the previous 12 months.

12. Applicable law and disputes

These terms are governed by French law. Failing an amicable settlement, any dispute falls within the jurisdiction of the courts of Paris.
